Terms and Conditions
It is agreed that the following terms and the Wedding Photography Contract set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.

Booking Retainer
The booking retainer secures the time and services of the Photographer for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time.

Payments
Following payment of the booking retainer, the balance of fees due is to be paid a minimum of 28 days prior to the wedding. Payment for any additional images required is to be made when they are ordered.

Display
By signing this Agreement the Bride and Groom hereby grant the Photographer a model release to use any photographs resulting from this Agreement for promotional purposes in the Photographer’s web site, portfolio, literature, display areas, exhibitions, competitions, advertising or slide shows.  No other commercial use of said photographs will be made by the Photographer.

Images
All image sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.
Image Retouching/Enhancement
All images included in albums, print packages and reprints will be retouched and, where appropriate, enhanced by the Photographer not only to ensure that all parties in the images look their best but also to impart the images with the Photographers signature style.  By signing this Agreement the Bride and Groom acknowledge the Photographer’s choice of retouching and enhancement as final.

Album Design
The Photographer shall prepare an initial design of the wedding album using the Photographer's selection of images. On receipt of the proof design the Bride and Groom are at liberty to select different images and modifications to the design layout of the album.

Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically or electronically or by any other means an image created as part of this contract without the permission of The Photographer/s in writing.

License
The Photographer shall be granted artistic license in relation to the poses photographed and the locations used. The Photographer’s judgment regarding the locations/poses and number of images taken shall be deemed correct.
Force Majeure or Act of God
The due performance of this Agreement is subject to alteration or cancellation by either party owing to any cause beyond their control.
Attendance
In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the wedding photography to his/her best ability.

Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

Cancellation
The Client may cancel this contract at any time by giving written notice to the Photographer but in doing so shall forfeit any monies paid. Cancellation less than 4 weeks before the wedding will result in the payment in full. All cancellations must be in writing.

Negatives/Digital Files
Negatives / digital files remain the property of the Photographer.

Requested Photographs
The Photographer will honour the Bride and Groom’s special requests for photographs providing the following conditions are met – weather and allocated time permitting, availability and cooperation of the person(s) concerned. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Coverage
The Photographer cannot be held responsible for the lack of coverage caused by: the Bride, the Groom or wedding party not being on time, the Church, Register Office, or licensed place of wedding having restrictions regarding photography. The Photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

Exclusivity
The Photographer shall be the exclusive photographer retained by client. Family and friends are obviously at liberty to take photographs but we would request that they do not disturb, disrupt or interfere with the Photographer’s duties. The Photographer has the right to kindly ask the person obstructing to refrain from doing so, in order for the Photographer to carry on their duties. It is our duty to provide you with a unique service. Any breach of this agreement will constitute a reason for non-completion of the job with no liability to the Photographer.

Pre-Wedding Shoot
When the Photographer undertakes a pre-wedding or engagement shoot, the location chosen may be the wedding venue or an alternative  location of the Bride & Groom's choice. The Photographer reserves the right to charge for additional mileage should this alternative location be further from  the Photographer's base in Norwich than the wedding venue.

Changes
Any changes or announcements that will affect our photography of your day including, but not limited to , timings, venue, etc should be notified to us in writing as soon as possible. Any circumstances not brought to the attention of the Photographer that affect our ability to photograph your day will not be the responsibility of the Photographer.
